At some point this is no longer about accessing education; it’s about accessing long term, full time personal care.

Since he was not in the care of the school at the time this would indicate that the responsibility for his care was under his parent or guardian’s responsibility.
To be clear, I don’t think anyone deserves *shame* or *punishment* for this; but what I am reading is that *Max required complicated care from one or more individuals who could provide him with their complete and total undivided attention*.
Again, at some point we shouldn’t consider this a problem for the school system to solve. Max needed more support than can be reasonably expected of the school district.

Why was this kid in a school instead of being cared for at home???
