Ich weiß, es ist schon eine Weile her, aber ich wusste nicht, dass ich auf Reddit Hilfe bekommen könnte. Kurz gesagt: Ich habe diese Wohnung gemietet, bin aber vorzeitig ausgezogen. Laut Vertrag habe ich jemanden gefunden, der meinen Mietvertrag übernimmt (hätte ich niemanden gefunden, hätte er mir 289 € für die vorzeitige Kündigung berechnet). Daher beträgt mein Kontostand 291 € (289 € erstattet + 2 € Gutschrift aus der vorherigen Aufladung).
Meine Kaution betrug 309 €. Er sollte mir im Oktober 2023 311 € überweisen, aber wir schreiben jetzt das Jahr 2026 und ich habe die Zahlung immer noch nicht erhalten. Ich habe ihm mehrere E-Mails geschrieben, aber er hat auf keine davon geantwortet.
Was kann ich tun, um an mein Geld zu kommen? Ich füge einen Screenshot des PDF-Dokuments bei, aus dem hervorgeht, dass er mir das Geld überweisen wird.
Und noch etwas Lustiges: Alle paar Monate schickt er mir eine Werbe-E-Mail, um Mieter für seine Wohnungen zu finden, und gibt mir 25 Euro, antwortet aber nicht auf meine E-Mails.

You could send ihm a more „official looking“ Mahnung via post to scare him off, invest into a Mahnbescheid or sue him, or just write of the money. Not much more you can do
You send him a „gerichtlicher Mahnbescheid“ from the court, if he does not react to it you now have an enforcable title against him.
If he pays, also fine.
If he does not pay AND rejects the claim, you sue him.
This also says that you need to pay him 289€ for moving out too early. Maybe he expects this payment first? Or if he subtracts it from your kaution, all you will be getting is like 20 bucks, right?
Did you opt in to the promotional emails he is sending? If not, you may charge him with a GDPR violation.
